The company LES DANDYS manufactures and markets directly or indirectly its articles (clothing and accessories) under the brand and trade name RIVES, throughout the world.

LES DANDYS is a limited liability company with a capital of €43,360, registered in the Paris Trade Register under number 514 499 375, with its registered office at 23, rue Pasquier 75008 PARIS, telephone: +33 (0)9 62 58 09 85, email: eshop@rives-paris.com, intra-community VAT number: FR90514499375 (hereinafter referred to as RIVES or the RIVES company).

Article 1: Périmètre d’application

The present “general conditions of sale” (hereinafter the GCS) apply to distance sales of RIVES articles and are reserved for consumers acting exclusively for their personal use (hereinafter the customer), it being specified that French law applies to any order placed on the RIVES Internet site, available at the address www.rives-paris.com (hereinafter the site) or by telephone with the sales advisers of the RIVES shop, and this, whatever the country of delivery chosen by the customer.

Any order not corresponding to a retail sale and, more generally, any fraudulent order may be refused by RIVES. RIVES therefore reserves the right to limit the quantities of an article delivered to the same consumer or to the same postal address.

The purpose of these general conditions is to inform any potential customer about the conditions of sale of RIVES articles to the customer and to define the rights and obligations of the parties.

For telephone sales, the customer is invited to consult and download the General Terms and Conditions available on the site before confirming the order.

With regard to sales on the site, by ticking a box provided for this purpose, the customer acknowledges having read the GTC before placing the order and having accepted them without reservation. The T&Cs can be retained by anyone visiting the site, by means of a download and can be printed.

RIVES reserves the right to modify the GTC at any time. Nevertheless, the GTC applicable to the order are those accepted by the customer at the time the order is placed.

The GTC are supplemented by the rules for the use of cookies and the personal data protection policy, which are available and can be downloaded from the website.

Article 2: Informations sur les articles

Information on RIVES products is available, with their references, in all RIVES shops, as well as on the website. The customer may select one or more items from the various categories offered on the site within the limits of available stocks. RIVES can modify at any time the items offered for sale on the site, without prejudice to the orders placed by the customer. For any questions or requests for advice, the client can contact the RIVES team of advisors.

Despite the care taken in the presentation of the items on the site, RIVES cannot guarantee that their actual appearance corresponds exactly to their appearance on the screen, particularly with regard to colour variations. The company RIVES cannot be held responsible for non-substantial errors that may occur.

RIVES reserves the right to withdraw items from sale at any time. In case of unavailability of one of the articles, the customer will be informed as soon as possible by the customer service. In case of unavailability of one or more items, the customer will be reimbursed by credit card or on his PayPal account and can proceed to a new order.

Article 3: Commandes

All orders imply acceptance of the GTC and the data processing policy unless specific contractual conditions are agreed between the parties.

3.1 Commandes téléphoniques

Orders will be received, in French or English, by the RIVES shop sales advisors at +33 (0)1 40 07 05 52 (price of a local call from metropolitan France), from Monday to Saturday, from 11am to 7pm, except public holidays.

The customer is invited to take note of the price of the articles on the site and to take note of the General Terms and Conditions of Sale also available on the site before validating his order by telephone.

The order is payable by credit card. The customer communicates by telephone; the number and the expiry date appearing on the front of his bank card as well as the numbers of the visual cryptogram appearing on the back (or the front) of his bank card. The order is delivered to the home address provided.

3.2 Commandes sur le site

Orders can be placed on the website. The customer shall bear the telecommunication costs of accessing the Internet and using the website. All the necessary steps for the sale are specified on the website. The customer, before definitively validating his order, takes note of the GTC, checks the details and the total price of his order, corrects any errors, before confirming his final agreement on the payment of the order.

The customer’s attention is drawn to the fact that the validation of an order implies the obligation to pay the agreed price and that once the order has been validated, the customer cannot cancel his order, subject to the exercise of his right of withdrawal (see article 7 below).

To definitively validate an order, you must click on the “Pay” button. From the moment the customer has validated the order, RIVES acknowledges receipt without delay and electronically. The company RIVES recommends that its customers keep these e-mails on paper or on computer. In the event of non-receipt of these e-mails, the customer is recommended to check whether they have not arrived in the spam box. The customer is informed that e-mails are sent to the e-mail address entered by the customer. Therefore, if there is an error in entering the relevant email address, or if the message confirming the dispatch or supply of the order is not received, RIVES cannot be held responsible (unless the receipt of the confirmation message is due to a fault of RIVES). In this case, the sale will be considered final. The customer may nevertheless exercise his right of withdrawal under the conditions set out in Article 7 of the GTC.

3.3 Commandes des articles sans création de compte sur le site

If the customer does not request the saving of the data necessary for the execution of the order, he/she does not create an account on the site. An invoice in electronic format will be sent by email when the order is shipped.

3.4 Refus, suspension ou annulation de commandes

RIVES reserves the right to refuse or cancel any order for which the number of items or the amount to be paid (for one or more cumulative orders) would not correspond to the average usual use of a household and to any order which would imply that an economic activity is carried out by the customer in relation to the ordered items or more generally, any abnormal order. Finally, RIVES reserves the right to suspend or cancel any execution of an order and/or delivery, in case of non-payment or partial payment of the price, in case of payment incident, or in case of fraud or attempt of fraud concerning the use of the site, including on the occasion of previous orders.

Article 4: Prix des articles

The price of the products is indicated inclusive of all taxes (TTC).

The price includes VAT and is denominated in euros.

RIVES offers various delivery methods. The customer is informed of the cost of delivery at the time of placing the order.

The selling prices of the articles online on the site are those in force at the time the order is placed by the customer. The selling prices of items may be changed by RIVES at any time. RIVES regularly checks that the prices charged are correct. However, some prices may be affected by an error. If RIVES notices a price error in the order, the customer will be informed as soon as possible. RIVES reserves the right to cancel the order of the item concerned by an obvious pricing error. If the order has been paid for, the customer will be refunded the amount paid immediately.

Upon confirmation of the order, the customer will receive written confirmation of the price paid for each item, detailing the price of the items.

Article 5: Conditions de paiement

Payment for orders on the site can be made:

– through the customer’s PayPal account. By choosing to pay via PayPal, the customer will automatically be directed to their PayPal account. Once the PayPal payment is validated, the customer will see the order confirmation page on the website.

– by credit card (cards from the “CB” network, Visa, Eurocard/Mastercard, American Express are accepted). In this case, the customer’s credit card is charged when the order is placed.

The customer guarantees to the company RIVES, that he is the holder of the bank card and that the name appearing on this bank card to be debited is his, then communicates in a secure environment on the Internet (PSP Stripe); the number and the expiry date appearing on the front of his bank card as well as the numbers of the visual cryptogram appearing on the back (or the front) of his bank card.

When ordering by telephone, the customer confirms that he/she is the credit card holder and that the name on the credit card to be charged is his/her own. He then communicates, by telephone, the number and expiry date appearing on the front of his credit card as well as the visual cryptogram numbers appearing on the back (or front) of his credit card.

In the event that the debit of the sums due by the customer is impossible for any reason whatsoever, the sale made by telephone will be immediately cancelled and the purchase process on the Internet will be immediately terminated.

Article 6: Livraison et réception

All the information concerning the delivery conditions is available on the page of validation of the basket and before the payment of the order.

Delivery times

Delivery times are indicated to the customer when the order is placed. The delivery of the ordered articles will take place within the deadlines communicated by the company RIVES, and within a maximum period of 30 days as from the day of the order (subject to the integral payment of the price).

The delivery period starts upon receipt of the order confirmation by e-mail. Delivery times take into account the time of the order and the working days of the destination country.

Delivery times can, during the holiday period or sales, be extended because of the strong activity of the company RIVES at this time of the year. However, these delays may not exceed 30 days after the conclusion of the order.

Shipping adress

Items ordered by the customer in accordance with the GTC shall be delivered to the address indicated by the customer as the delivery address on the relevant order (“delivery address”);

If delivery is not possible due to the absence of the recipient at the place of delivery, a notice will be left at the delivery address indicated by the customer and the carrier will make a new delivery attempt on the next working day.

6.3  Emballage ou produit endommagé, produit manquant

The customer, or the recipient of the order, is invited to check the apparent condition of the package and the articles on delivery.

WARNING: In the event of a damaged package or product, or a missing product, the customer or his representative must follow the procedures described below. Failure to comply with the appropriate procedure excludes any recourse against the carrier and RIVES.

The customer must contact customer service within 7 days of receipt at eshop@rives-paris.com with a photo of the item concerned and follow the same return procedure as described and detailed in Article 7.

Article 7: Droit de rétractation

Pursuant to Article L. 221-18 of the French Consumer Code, the customer has a right of withdrawal in the case of a sale made at a distance on the website or by telephone. The customer may exercise this right, without having to give reasons, within 14 days of receipt of the product by the customer or his authorised representative. Any request for return made after this period may be rejected.

If the customer has placed an order with several products, the withdrawal period does not start until the customer or the designated third party has received the last product.

In accordance with Article L. 221-28 of the Consumer Code, the right of withdrawal cannot be exercised for orders relating to:

– the supply of goods manufactured to the customer’s specifications or clearly personalised;

– the supply of goods that have been unsealed after delivery and cannot be returned for reasons of hygiene or health protection.

In order for the return and refund to be validated and processed quickly, the customer or his authorised representative must follow the procedures described below. Failure to do so may result in the refusal of the return and the return of the product to the customer without refund.

RIVES has a 14 working day return policy: any unwanted item must be returned to us within 14 days of receipt using the return label provided in your original package. Please read our returns procedure carefully, failure to do so may result in your order being returned without refund.


The refund will be credited to the cardholder’s credit card or to the customer’s PayPal account.

The refund will be made within 14 days of receipt of the returned item.

No refund will be made if the item is not returned in perfect condition.

No refund will be made if the customer does not follow the return procedure.

If shipping costs were paid at the time of shipment, they will be refunded.

Informations importantes

Items must be returned in perfect condition, exactly as delivered, with the label and seal still attached. All shoes must be tried on a carpeted surface until the customer decides to keep them. If the item is reported as faulty and/or has been received damaged, you must contact us within 7 days of receipt with a photo and a detailed description of the fault.

The above policy also applies during sales.

Article 8: Garanties légales 

All RIVES products are covered by the guarantee of conformity and the guarantee against hidden defects. These are legal guarantees that apply independently of any other commercial guarantee that may be granted by RIVES and of the right of retraction provided for in article 7.

8.1 Garantie de conformité

Article L217-4 of the Consumer Code states that: ” The seller shall deliver goods in conformity with the contract and shall be liable for any lack of conformity existing at the time of delivery. He shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was made his responsibility by the contract or was carried out under his responsibility. “

In accordance with Article L217-5 of the Consumer Code, « the goods conform to the contract :

1° Whether it is fit for the use normally expected of similar goods and, if so :

– if it corresponds to the description given by the seller and has the qualities presented to the buyer in the form of a sample or model;

– it has the qualities that a purchaser may legitimately expect, having regard to the public statements made by the seller, the producer or his representative, particularly in advertising or labelling;

2° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the seller’s attention and accepted by the latter.

The action resulting from the lack of conformity is prescribed within two years from the delivery of the goods, as provided for in Article L211-7 of the Consumer Code.

The customer may choose between repairing or replacing the item, subject to the cost conditions envisaged by Article L. 217-9 of the Consumer Code;

It is possible that stocks do not allow for the replacement of the same item. Consequently, and in any event, the customer will be reimbursed for the non-conforming item and replaced by an item of equivalent price, if the customer so wishes by placing a new order.

8.2 Garantie contre les vices cachés

Article 1641 of the Civil Code states that: “The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it was intended, or which so diminish that use that the buyer would not have acquired it, or would only have given a lower price for it, if he had known about them.”

Article 1648 of the Civil Code states that: “The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.L’action résultant des vices rédhibitoires doit être intentée par l’acquéreur dans un délai de deux ans à compter de la découverte du vice”.

Within the framework of the legal guarantee of the hidden defects the company RIVES, in accordance with the article 1644 of the civil code, and according to the choice of the customer, engages after evaluation of the hidden defect:

– Or to refund the full price of the returned item,

– Or to refund part of the price of the item, if the customer decides to keep the item.

8.3 Retour des produits

In the event of a hidden defect or non-conforming product, the customer is invited to contact customer service at eshop@rives-paris.com and to follow the same return procedure as described in article 7 above.

8.4 Exclusion des garanties

Items modified or repaired by the customer are excluded from the warranty. In the same way, the guarantee will not apply to apparent defects in accordance with Article 1642 of the Civil Code. Finally, the warranty will not cover items damaged in transit or due to misuse.

Article 9: Réclamations-informations

For any information, complaint or question concerning the GTC or the products, the customers must contact the customer service of the company RIVES by telephone: +33 (0)1 40 07 05 52 (price of a local call), or by email at the address eshop@rives-paris.com by recalling their number of order, if necessary.

Article 10: Personal data and rules for the use of cookies

RIVES undertakes to protect and guarantee the security and confidentiality of its customers’ personal data in accordance with the RGPD, in particular by taking all necessary precautions to prevent such data from being distorted, damaged or accessed by unauthorised third parties.

The customer is invited to read and download the data protection policy and the rules of use of cookies of the company RIVES available on the website.

Article 11: Réserve de propriété

The company RIVES keeps the full property of the sold articles until the complete payment of the price including all taxes and the possible costs of delivery and the additional expenses generated at the express request of the customer.

Article 12: Droits de propriété intellectuelle

The “RIVES” trademark, as well as all figurative or non-figurative trademarks and more generally all other trademarks, illustrations, images and logos appearing on RIVES articles, their accessories or their packaging, whether registered or not, are and will remain the exclusive property of RIVES.

Any reproduction, modification or use, in whole or in part, of these trademarks, illustrations, images, logos, or any combination or conjunction with any other trademark, symbol, logo and, more generally, any distinctive sign intended to form a composite logo, on any or all of them, without the express prior consent of the company RIVES, is strictly forbidden.

The same applies to all copyrights, drawings and models, patents which belong to the RIVES company.

The use of all or part of the site, including downloading, reproduction, transmission or representation for other than personal and private non-commercial purposes is strictly prohibited.

Any violation of these provisions exposes its author to the sanctions provided for by the civil code and the intellectual property code.

In addition, the creation of a hypertext link to the RIVES website can only be done with the prior and express agreement of the RIVES company.

This agreement may be revoked at any time if the conditions of the authorisation are not met.

The company RIVES declines all responsibility for the conditions of use and the content, whatever it may be, of third party sites from which hypertext links allow access to the Lemaire site.

Article 13: Signature et preuve

RIVES strives to protect the personal information of its customers by guaranteeing a high level of security.

Customers also have a role to play in protecting their personal data. In particular, he/she must maintain the security of his/her online transactions by not disclosing his/her username (e-mail address) and/or password to anyone and by changing his/her password regularly.

Consequently, RIVES cannot be held responsible for the disclosure of information about the customer to any person who has used the customer’s identifier (e-mail address) and/or password.

The company RIVES declines all responsibility in case of fraudulent use of this information.

The provision of the credit card number or the payment of the sums due and the final validation of the order shall be proof of acceptance of the said order.

The computerized registers kept in the computer systems of RIVES and its partners will be considered as proof of communications, orders and payments between the parties.

Article 14: Force majeure

In accordance with article 1218 of the Civil Code, RIVES will suspend all execution of its contractual obligations in the event of force majeure.

RIVES will inform the customer within seven (7) days of its occurrence. If this suspension continues beyond a period of fifteen (15) days, the customer would then have the possibility of cancelling the order in progress, and would then be refunded.

Article 15: Litiges-loi applicable

If the customer encounters a problem concerning a product, the site or any other service of the company RIVES related to the site or a product, he is invited to contact the customer service at the following address: customerservice@RIVES.fr

In the event that the problem is not resolved, in accordance with the provisions of the Consumer Code concerning “the mediation process for consumer disputes”, the customer has the right to use a mediation service free of charge. The customer is informed that he/she can use the European online dispute resolution platform for cross-border disputes (RLL) available at the following address: https://ec.europa.eu/consumers/odr/main/index.cfmS
